Design Procedure

1. Find out if the design has been registered before or not. The Design Office can assist you with the search.
2. A precise representation of the design should be prepared on white A4 size paper of robust quality.
3. A design mustbe categorized in a particular class in order to register systematically. An internationally accepted classification ofIndustrial Designs based on the function of the item is required on the application.
4. The applicant must provide a statement of novelty asper the Act in order to make aclaim. This will expedite theapplication process and provide more specific protection.
5. If the applicant has applied for protection of the design in convention countries, thenthey canregister the design by citing a priority date in India. This is the date on which the application was filed in any convention countries. However, the application should be filed in India within six months.
